Terms of Service for Neap

1. Acceptance of Terms

By downloading, installing, or using Neap ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Neap is a focus and productivity application that helps users limit their screen time by temporarily blocking access to selected apps and categories during focus sessions. The App uses Apple's Screen Time API to provide this functionality.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on devices you own or control, subject to these Terms and Apple's App Store Terms of Service.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Grant necessary permissions for the App to function properly (Screen Time access)
• Not attempt to circumvent, disable, or interfere with the App's functionality
• Not reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage, disable, or impair the service

5. Premium Subscriptions

Subscription Terms

• Premium features are available through auto-renewable subscriptions
• Subscription options: Weekly and Yearly plans
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

Managing Subscriptions

• You can manage or cancel your subscription in your Apple ID Account Settings
• No refunds will be provided for unused portions of a subscription term
• Free trial periods, if offered, will be forfeited when purchasing a subscription

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

7. Intellectual Property

The App and all associated content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Disclaimers

No Guarantee of Results

While Neap is designed to help improve focus and productivity, we do not guarantee specific results. The effectiveness of the App depends on individual usage and commitment.

Screen Time API Limitations

The App's functionality depends on Apple's Screen Time API. We are not responsible for any limitations, changes, or issues with this API that may affect the App's performance.

As-Is Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the App will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.
